SALARY INCOME OF Central/State/PSU EMPLOYEES IS NO BAR FOR CREAMY LAYER. As per the creamy-layer criteria issued by Government of India DOPT O.M. No.36012/22/93-Est. (SCT) dated 8.9.1993 (available on http://www.ncbc.nic.in and adopted by Supreme Court for recent 27% obc reservation in higher educational institutes in judgment of W.P. 265/2006) following important point is misinterpreted. Normally a candidate having parent’s salary above Rs. 2.50 Lake per annum is not trying to get obc caste certificate, WHICH IS WRONG.
(1) Actually the creamy-layer limit of Rs. 2.50 lakhs is not meant for “government servants” and “farmers”. It is the limit for “business income” only. As the government servants are to be checked by their “post held” and farmers by their “land holdings” hence can not be checked by salary/agricultural income.
(2) In rule- (6) showing creamy-layer limit of Rs. 2.50 lakhs the following explanation is already given- “Income from salaries or agricultural land shall not be clubbed with income” because there is a separate rule (2) %26amp; (3) of ‘post held’ provided for salaried persons %26amp; a separate rule (5) is provided for the persons holding agricultural land.
(3) The rule (2) %26amp; (3) clearly speaks that only the following “government servants” will be treated as creamy-layer.
(i) Parents, either of whom is a Class I officer. (Direct Recruitment)
(i) Parents, both of whom are Class II officers. (Direct Recruitment)
(iii) Parents of whom only the husband (father) is a Class II officer and he gets into Class I at the age of 40 or earlier.
(iv) In military, colonel and above.
Note- Other than the above 4, entire OBC government servants (Central/State/PSUs) of the country will not fall under creamy-layer.

Please inform the ceiling income limit of OBC(non creamy layer) for admissions into GATE?
The limit of income for determining the creamy layer status was raised to Rs. 2.5 lakh vide this Department's OM of even number dated 9.3.2004. It has now been decided to raise the income limit from Rs. 2.5 lakh to Rs. 4.5 lakh per annum for determining the creamy layer amongst the OBCs. Report Abuse

According to my knowledge it should be aroun 1.25 lac per annum
